Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Treblemakers ("we," "us," "our," or "Company"), governing your access to and use of Treblemakers (the "Service"), available at treblemakers.shop.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. Your continued use after any changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years of age to use the Service. Users between 13 and 18 may only use the Service with the informed consent of a parent or legal guardian who agrees to be bound by these Terms on behalf of the minor.
By using the Service, you represent and warrant that you: (a) are at least 13 years old; (b) have the legal capacity to enter into these Terms; (c) are not barred from using the Service under applicable law; and (d) will provide truthful and accurate registration information.
If we learn that a user is under 13, we will promptly terminate their account and delete their personal information in accordance with our Privacy Policy.
3. Account Registration
To access certain features — including saved searches, favorites, price watches, and subscription plans — you must create an account via our authentication provider, Clerk, using Google OAuth or magic link sign-in. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use at [email protected].
You may not create more than one account, share account credentials, or transfer your account to another person without our written consent. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Description of Service
Treblemakers is a used musical instrument search engine and price aggregator. The Service searches across multiple third-party marketplaces — including Reverb, eBay, Guitar Center, Sweetwater, zZounds, Musician's Friend, Amazon, and independent shops — to help you find and compare used instrument listings in one place.
Key features include:
- AI-Powered Search: Natural language search queries parsed by artificial intelligence to understand instrument type, condition, price range, brand, and other attributes.
- Price Aggregation: Comparison of listings across multiple marketplaces in a single search interface.
- Price Watches: Alerts when listings matching your criteria drop below a specified price.
- Saved Searches & Favorites: Save search queries and bookmark individual listings for later reference.
- Affiliate Redirects: When you click on a listing, you are redirected to the third-party marketplace via an affiliate link (see Section 6).
We do not sell instruments directly. All purchases are made on the respective third-party marketplace and are subject to that marketplace's own terms, policies, buyer protections, and return policies. Treblemakers is not a party to any transaction between you and a third-party seller.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that reduce paid-tier functionality, we will provide at least 30 days' notice.
5. Subscriptions and Billing
5.1 Payment Processing
All paid subscriptions are processed through Whop, Inc. ("Merchant of Record"). By purchasing a subscription, you also agree to Whop's terms of service and privacy policy.
As Merchant of Record, Whop is responsible for: processing payment transactions, managing sales tax collection and remittance, handling chargebacks and payment disputes, and PCI DSS compliance for payment card data.
We do not directly collect, store, or process your payment card information.
5.2 Subscription Plans
The Service offers both free and paid tiers:
- Free tier: Basic search, limited price watches, standard AI search quota.
- Paid tiers: Unlock additional features including unlimited price watches, advanced filters, priority alerts, and expanded AI search quotas. Current plans, pricing, and features are available at treblemakers.shop/pricing.
Feature availability may change. We will notify paid subscribers at least 30 days in advance of changes that materially reduce their tier's functionality.
5.3 Billing Cycle and Auto-Renewal
Paid subscriptions are billed in advance on a recurring monthly basis. Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You will be charged on the same date each month (or the nearest available date if the original date does not exist in a given month).
CALIFORNIA RESIDENTS — AUTO-RENEWAL NOTICE (Cal. Bus. & Prof. Code § 17600 et seq.): Your subscription will automatically renew each month at the price disclosed at the time of purchase, plus applicable tax. Before each renewal, Whop (our payment processor) processes the charge to your payment method on file. You may cancel at any time through your account settings before the next billing date to avoid being charged for the next period.
5.4 Price Changes
We reserve the right to change subscription prices. For existing subscribers, price changes take effect at the start of the next billing cycle following at least 30 days' written notice via email. You may cancel before the price change takes effect.
5.5 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Upon cancellation:
- Your subscription remains active until the end of the current billing period you have already paid for.
- You retain access to paid features until that period expires.
- After expiration, your account reverts to the free tier. Your data (favorites, saved searches, price watches) is preserved, though some features may become inaccessible.
- Cancellation does not retroactively entitle you to a refund for the current billing period.
5.6 Free Trials
We may offer free trial periods for paid subscriptions. If offered:
- The trial duration and terms will be clearly disclosed before you enroll.
- Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged at the disclosed rate.
- You will receive a reminder before the trial converts to a paid subscription.
- Free trials are limited to one per person. Creating multiple accounts to obtain additional free trials is prohibited.
6. Affiliate Links, Commissions, and Disclosures
6.1 How We Earn Revenue
Treblemakers earns revenue primarily through affiliate commissions. When you click on a listing in our search results, you are redirected to the third-party marketplace through an affiliate link. If you make a purchase on that marketplace, we may earn a commission from the marketplace or its affiliate network at no additional cost to you. The price you pay is the same whether or not you click through our affiliate link.
6.2 No Ranking Influence
Our affiliate relationships do not influence search result ranking or listing presentation. Listings are ranked by relevance to your search query (based on AI-parsed intent, keyword match, and listing freshness), not by commission rates, affiliate network, or marketplace preference.
6.3 Affiliate Networks
Affiliate networks we participate in include, but are not limited to:
- Awin (Reverb)
- Commission Junction / CJ Affiliate (Sweetwater)
- FlexOffers (Musician's Friend)
- Amazon Associates (Amazon)
- eBay Partner Network (eBay)
- Direct affiliate programs with other retailers
6.4 Amazon Associates Disclosure
Treblemakers is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, Treblemakers earns from qualifying purchases.
6.5 Full Disclosure

6.6 Marketing Attribution
We use marketing-attribution technology to measure which campaigns and channels drive purchases, form submissions, and outbound clicks to our affiliate partners. See our Privacy Policy §9.6 for details on this technology and how to opt out.
7. Refund Policy
Refund requests are evaluated on a case-by-case basis and must be submitted within 14 days of the charge date by contacting us at [email protected]. Grounds for refund may include:
- Technical issues that prevented you from accessing the Service for an extended period.
- Being charged after a cancellation was confirmed.
- Billing errors.
Partial-month refunds are not provided for voluntary mid-cycle cancellations. Chargebacks initiated without first contacting us may result in account suspension pending investigation. Refunds are processed through Whop.
8. Acceptable Use
8.1 General Prohibitions
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation.
- Infringe on the intellectual property rights of any third party.
- Transmit defamatory, obscene, threatening, abusive, harassing, or hateful material.
- Upload viruses, malware, ransomware, or other malicious code.
- Attempt unauthorized access to the Service, other user accounts, or our infrastructure.
- Interfere with or disrupt the integrity, performance, or availability of the Service.
- Create multiple accounts to circumvent restrictions, rate limits, bans, or free trial limitations.
- Resell, sublicense, or redistribute access to the Service without authorization.
- Use the Service to build a competing product, service, or dataset.
- Attempt to manipulate, inject into, or subvert AI-powered search features (prompt injection, jailbreaking, or other adversarial techniques).
8.2 Prohibition on Automated Access and Data Extraction
You may not, without our prior written permission:
- Use any automated tool — including bots, scrapers, crawlers, spiders, headless browsers, or scripts — to access, index, or extract data from any part of the Service.
- Programmatically access or follow our affiliate redirect links (
/goto/and similar endpoints). These links are provided exclusively for human user navigation and are protected by technical access controls, including cryptographic signature tokens. Automated access to these endpoints constitutes unauthorized access to a protected computer system under the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and equivalent state and international laws. - Systematically harvest, collect, copy, or store listings, prices, search results, redirect destinations, or any other data from the Service for commercial purposes.
- Reverse-engineer, decompile, disassemble, or attempt to derive the structure, inventory coverage, indexing logic, affiliate link structure, or data sourcing strategy of the Service.
- Circumvent, bypass, remove, deactivate, or impair any technical protection measures we employ, including rate limiters, HMAC-signed access tokens, IP-based controls, or bot detection systems.
- Probe, scan, or test the vulnerability of the Service or its infrastructure without our explicit written authorization.
Our cryptographic tracking tokens (HMAC-signed identifiers used in affiliate redirect links) constitute access credentials under 18 U.S.C. § 1030(e)(6). Attempting to forge, replay, enumerate, or otherwise tamper with these credentials constitutes unauthorized access regardless of whether the attempt succeeds.
8.3 Monitoring and Enforcement
We actively monitor the Service for unauthorized automated access and employ technical countermeasures including, without limitation:
- Rate limiting and traffic analysis
- HMAC cryptographic signature verification on redirect endpoints
- Honeypot detection links — invisible to human users but detectable by automated tools — that log accessing IP addresses, user agents, timestamps, and request details
- Firewall rules blocking known bot infrastructure
- Bot behavior classification systems
Evidence collected by these systems may be used in legal proceedings. By accessing the Service, you consent to this monitoring to the extent permitted by applicable law.
8.4 Liquidated Damages for Automated Abuse
If you violate Section 8.2, you agree to pay liquidated damages of $500 per unauthorized request to the /goto/ affiliate redirect endpoint or any protected technical resource of the Service. The parties agree this amount is a reasonable estimate of the damages caused by each such violation — including affiliate revenue disruption, infrastructure costs, engineering remediation time, and competitive harm — and is not a penalty. This liquidated damages provision does not limit our right to seek additional actual damages, injunctive relief, or other remedies available at law or equity.
We reserve the right to investigate suspected violations and to suspend or terminate accounts, block IP addresses, and pursue civil and criminal remedies at our sole discretion.
9. Intellectual Property
9.1 Our Intellectual Property
The Service — including its software, source code, algorithms, design, user interface, text, graphics, logos, and documentation — is the property of Treblemakers or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. The Treblemakers name, logo, and related marks are trademarks of Treblemakers.
9.2 Your License
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal or internal business purposes, subject to these Terms.
9.3 Third-Party Content
Instrument listings, images, descriptions, and prices displayed in search results are the property of the respective third-party marketplaces and their sellers. We aggregate and display this information for search and comparison purposes. We do not claim ownership of third-party listing content.
10. User Feedback
If you submit feedback, suggestions, feature requests, or ideas about the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the Service without obligation or compensation to you. You acknowledge that Feedback is not confidential, and we have no obligation to use any Feedback you provide.
11. AI-Generated Content
The Service uses artificial intelligence ("AI") to parse search queries and enhance search results. AI features are powered by OpenAI (primary) and Anthropic, PBC (fallback), accessed through the Vercel AI SDK.
Important limitations:
- AI-generated content — including parsed search parameters, listing categorization, and search result ordering — is provided for informational purposes only and does not constitute professional advice of any kind (financial, legal, musical, or otherwise).
- We do not guarantee the accuracy, completeness, reliability, or timeliness of AI-generated content.
- AI may misinterpret your search query, return irrelevant results, or miss relevant listings.
- You assume all risk associated with any reliance on AI-generated content, including but not limited to purchasing decisions made based on AI-enhanced search results.
- Search queries submitted to AI features are subject to automated content filtering and prompt injection detection. Queries that trigger security filters may be blocked.
12. Third-Party Marketplaces and Services
The Service aggregates listings from third-party marketplaces. We are not a party to any transaction between you and a third-party seller. We are not responsible for:
- The accuracy, currency, or completeness of listing information (prices, descriptions, conditions, images, availability) on third-party marketplaces. Listings may be out of date, sold, or have changed price since we last indexed them.
- The quality, safety, legality, or authenticity of items listed on third-party marketplaces.
- Fulfillment, shipping, delivery, returns, or refunds for purchases made on third-party marketplaces.
- The terms of service, practices, or privacy policies of third-party marketplaces.
- Any disputes between you and a third-party seller.
Use of third-party services is entirely at your own risk and subject to their respective terms.
13. Electronic Communications
By creating an account, you consent to receive electronic communications from us, including:
- Account notifications (password resets, security alerts, account changes).
- Transactional emails (price watch alerts, saved search notifications).
- Service announcements (new features, maintenance windows, Terms/Privacy updates).
- Marketing emails (promotional offers, product updates) — you may opt out at any time.
You agree that all communications we provide electronically satisfy any legal requirement that such communications be in writing.
14. Privacy
Our collection and use of your personal information is described in our Privacy Policy, which is incorporated herein by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
15. Children's Privacy (COPPA)
Our Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us immediately at [email protected]. We will:
- Investigate within 48 hours of receiving your report.
- Promptly delete all personal information associated with the child's account.
- Terminate the child's account.
For users aged 13–17, a parent or guardian must consent to these Terms on the minor's behalf.
16. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, error-free, or secure.
- Defects will be corrected in any particular timeframe.
- The Service or servers are free of viruses, malware, or other harmful components.
- Listing data from third-party sources is accurate, current, complete, or available for purchase.
- AI-generated search results will be correct, relevant, or comprehensive.
- Prices displayed will match the current price on the third-party marketplace.
- Any particular listing or instrument will be available when you visit the marketplace.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREBLEMAKERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- DAMAGES ARISING FROM RELIANCE ON LISTING DATA, PRICING INFORMATION, OR AI-GENERATED CONTENT.
- DAMAGES FROM PURCHASES MADE ON THIRD-PARTY MARKETPLACES ACCESSED THROUGH THE SERVICE.
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT.
- DAMAGES RESULTING FROM SERVICE INTERRUPTIONS, BUGS, OR ERRORS.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50).
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
18. Indemnification
You agree to defend, indemnify, and hold harmless Treblemakers, its officers, directors, employees, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
(a) your use of, or inability to use, the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) any purchases you make on third-party marketplaces accessed through the Service; (e) any content you submit through the Service; or (f) your violation of any applicable law or regulation.
19. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, suspected fraud, extended inactivity, or legal requirement.
Upon termination:
- Your right to use the Service ceases immediately.
- We may (but are not required to) delete your account data per our Privacy Policy's retention schedule.
- You may request a copy of your data before termination takes effect by contacting us.
- Any accrued rights or obligations, and any provisions that by their nature should survive (including Sections 9, 10, 16, 17, 18, 20, and 21), shall survive termination.
20. Dispute Resolution
20.1 Informal Resolution First
Before initiating any formal dispute, you agree to first attempt to resolve the issue informally by contacting us at [email protected]. We will make a good-faith effort to resolve the dispute within 30 days of receiving your complaint.
20.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitrationadministered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as otherwise provided herein.
- The arbitration shall take place in the State of Texas.
- The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
- The arbitrator shall apply Texas law consistent with the Federal Arbitration Act (9 U.S.C. §§ 1–16).
- Each party bears their own attorneys' fees and costs, unless the arbitrator awards fees to the prevailing party.
20.3 Arbitration Opt-Out
You may opt out of the arbitration provision by sending a written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, account email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts in Texas.
20.4 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
20.5 Small Claims Court
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
20.6 Equitable Relief
Nothing in this Section prevents either party from seeking injunctive or other equitable relief in court for matters relating to intellectual property, data security, or unauthorized access.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
22. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, power failures, internet outages, cyberattacks, third-party service outages (including marketplace APIs, hosting providers, or payment processors), or labor disputes.
23. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes via email or in-app notification. Non-material changes (clarifications, formatting) may be made without notice.
The "Version" number at the top of this document will be incremented with each update. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree with the changes, you may cancel your subscription and delete your account before the effective date.
24. General Provisions
24.1 Entire Agreement
These Terms, together with our Privacy Policy, Affiliate Disclosure, and any additional terms for specific services, constitute the entire agreement between you and Treblemakers regarding the Service and supersede all prior agreements and understandings.
24.2 Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
24.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
24.4 Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign our rights and obligations under these Terms without restriction.
24.5 Notices
Notices to you will be sent to the email address associated with your account. Notices to us should be sent to [email protected]. Notices are deemed received when sent via email.
24.6 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights. Third-party marketplaces, affiliate networks, and other service providers are not intended beneficiaries of these Terms.
24.7 Export Compliance
You agree to comply with all applicable export control and sanctions laws and regulations. You may not use the Service if you are located in a country subject to U.S. embargo or are on any U.S. government restricted party list.
